1. Terms

General terms

  1. By accessing the website at https://snapisms.io/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use Licence

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Snapi SMS's website for personal, non-commercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Snapi SMS's website;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Snapi SMS at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

  1. The materials on Snapi SMS's website are provided on an 'as is' basis. Snapi SMS makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, Snapi SMS does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

General terms

  1. In no event shall Snapi SMS or it's suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Snapi SMS's website, even if Snapi SMS or a Snapi SMS authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

  1. The materials appearing on Snapi SMS's website could include technical, typographical, or photographic errors. Snapi SMS does not warrant that any of the materials on its website are accurate, complete or current. Snapi SMS may make changes to the materials contained on its website at any time without notice. However Snapi SMS does not make any commitment to update the materials.

  1. Snapi SMS has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Snapi SMS of the site. Use of any such linked website is at the user's own risk.

7. Modifications

  1. Snapi SMS may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Accounts

General terms

  1. Snapi SMS provides the ability for you (the user and/or customer) to register an account. By creating an account, you agree that your data will be stored in our database that we may view this data at any time in order to improve and maintain our system.
  2. You are liable for the information that you provide upon account registration, and you confirm that you're aged 18 and over to create an account.
  3. Snapi SMS may at anytime revoke the ability for you to access your account and we may terminate your account or limit the functionality within your account if we see reasonable reason to do so.
  4. Any information you provide to us within your account is considered to be acccurate and not misleading in any way.
  5. When creating an account with us, you will be required to verify your email address. If your email address hasn't been verified within 5 days of creating your account, we will automatically remove your account.

Nature of account suspension

  1. Snapi SMS reserves the right to suspend your account at any time regardless of your account's credit balance.
  2. We reserve the right to suspend your account if we identify possible fraud. If your account becomes suspended, you must make contact with us for us to verify your identity.

9. Messaging

General terms

  1. We reserve the right to suspend your account, regardless of your credit balance if we identify patterns of suspicious and/or abusive behaviour.
  2. Each time you send a message we will deduct at least one credit from your API key's balance, the key used to send the message. We may be required to deduct more than one credit as some countries support fewer messaging limit characters, this information is covered in our API docs.

Supported countries

  1. We make every effort to support sending to as many different countries possible. However, we cannot guarantee that sending a message will reach your country.
  2. We have a public list of supported countries which you can view to check if yours is listed. Please always ensure that you check this list prior to purchasing SMS credits.

API keys and SMS country

  1. API keys must have a country assigned to them, this cannot be changed at a later date. When purchasing SMS credits, these credits are assigned to the individual API key along with the selected SMS country. The SMS country cannot be changed after the purchase of SMS credits have been assigned.
  2. You can only send text messages to countries supported by your API key's region. When attempting to send a message, you may be presented with an error suggesting to try a different code. You won't be charged any credits for this.

Sending recurring SMS? Provide opt-out language

  1. If you're sending recurring SMS messages, you should provide easy-to-follow opt-out language, for example, Opt-out at snapisms.io/optout.
  2. We automatically process opt-out requests when a recipient replies STOP to the message. This behaviour cannot be changed. Recipients may also opt-out via our web page url: snapisms.io/optout by providing their mobile number.

Recipients must opt-in

  1. When sending SMS messages, recipients of your texts must have opted into receiving your messages. Snapi SMS shouldn't be used for bulk advertising and/or spam messaging. We reserve the right to identify these cases and suspend your account without notice.

Identifying yourself

  1. You must identify yourself when sending text messages. You can do this by indicating your name and/or business within the SMS message content. We reserve the right to suspend accounts without notice if we identify cases that do not include this information.

No illegal use

  1. You must not send text messages that break the law in any country. This includes messages that promote scams, phishing, fraud, drugs, harassment or any other abusive and/or destructive use. Repeated harassment and unwelcomed messages are also prohibited from the Snapi SMS platform. Phishings simulation, penetration testing, and "security research" are not allowed. Snapi SMS reserves the right to identify thees cases and suspend your account without notice.

Messaging compliance

  1. You should ensure that the contents of your messages are compliant at all times. Please ensure that you follow all local and international laws associated with sending text messages. Failure to follow these instructions may result in us suspending your account without, or with notice.

Message contents

  1. Snapi SMS may scan messages prior to them being sent on our platform and automatically reject these messages if they contain profanity words, URLs or other content deemed unsuitable to be sent in a text message. Snapi SMS reserves the right to identify thees cases and suspend your account without notice.
  2. Snapi SMS may block messages that contain evidence of URLs. Your account will require a higher level in order to send messages containing URLs, this activation can be aquired by reaching out to us via our support page. We reserve the right to dismiss these requests of higher account level activation without reply, and also reserve the right to downgrade your account level at any time.

Country specific rules and regulations

  1. You must research the rules and regulations of the country or countries that you plan to send messages to and adhere to these rules at all times. Failure to follow coutnry specific rules may result in your account being terminated with or without notice/
  2. You should not send messages to countries after 9pm and before 9am local time as these messages could be categorised as spam.
  3. You must not attempt to send messages to premium rate mobile numbers, for example, when sending to the UK, premium rate numbers start with but are not limited to: 4455, 4484, and 4489.

  10. Credit repair programs
  11. Deceptive work-from-home programs

  15. Cannabis (Any country and/or region)

  18. Drugs that require a prescription - Offers for drugs that cannot be sold over-the-counter in the US/Canada are forbidden.

Profanity

  1. Your messages must not contain abusive or profanity words. We reserve the right to block, terminate or suspend API keys and or accounts that show evidence of this behaviour without any notice from us.

IP address

  1. We may temporarily or permanently block your IP address if we detect patterns of abusive behaviour. This especially applies to IPs associated with Tor and other anonymising services.

10. Notifications

General terms

  1. Snapi SMS will send you reasonable notifications that may arrive by either email or push notifications.
  2. We can not guarantee that you will receive notifications even if you've opted in, there may be technical constraints or maintenance work carried out that means you won't receive these.

11. Marketing communications

General terms

  1. By agreeing to our terms, you agree to receive marketing communications from us through various different channels which include but aren't limited to: Email, SMS and Push.

11. Payment and Renewal

General terms

  1. SMS credits are assigned to API keys and not your account.
  2. If you're purchasing a "Top up", then this is a one-time payment, we will process your card and assign credits to your API key.
  3. Payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. For any upgrade or downgrade in plan level, the credit card that you provided will automatically be charged or credited the new prorated amount for the current payment period and the new rate will apply on your next billing cycle. Snapi SMS reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you.
  4. Unused credit balances are automatically removed after 180 days of inactivity. You must send at least 1 SMS message within this time to retain your credit balance.

Minimal Hardware and Software Requirements for Using Snapi SMS.

  1. Snapi SMS can be used with any operating system (including mobile) that can run a modern browser (IE8+, Google Chrome, Safari, Firefox).

Purchase Process

Services provided by Snapi SMS can be purchased through the "Subscription" or "Add funds" that can be reached after logging in to the products. You may also get to this via our "Pricing" page or any special page or link we share in the future. The process works as:

  1. You select the desired product, for example: Monthly auto top-up, or single purchase
  2. You choose your API key that you'd like to assign credits to along with the SMS country.
  3. Complete the payment with a credit card or debit card
  4. We'll automatically then enable your subscription or add funds to your cerdit balance and you will be charged.

Automatic Renewal (applies only to subscription API keys)

  1. Unless you notify Snapi SMS before the end of the applicable subscription period that you want to cancel, your subscription will automatically renew and you authorize us to collect the then-applicable subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you when your credit balance reaches a low level. We define a "low level" as 0 credits but may also extend this to 2% left in credit. you can disable this subscription process at any time in your API key settings.

Refunds

  1. You may terminate your subscription at any time and you will not be obligated to pay any additional fees for upcoming subscription renewal periods. However, any subscription fees you have paid in advance will not be refunded unless there has been 24 hours or less since the payment. For payments made in the last 24 hours or less, only those payments are refundable.
  2. Our "Money back guarantee" offer only applies for new subscriptions or one-time payments taken out. You must reach out to us via email or through one of our other contact methods within the 24 hours of starting your subscription or making a one-time purchase for us to issue you a refund. Your refund will be issued providing that you've supplied your email address used to subscribe to our Pro plan and the date of subscription purchase, you'll also need to attach the invoice of said invoice amount for us to verify this. We will not issue refunds beyond this period.
  3. Failure to supply the required information as noted above will mean you automatically are no longer eligible for a money back.
  4. Failure to supply the required information as noted above, within the 24 hour window, even if we've made contact with you will mean you automatically are no longer eligible for a money back.
  5. Before issuing refunds, we will attempt to make contact with you to assess the reason for a refund.
  6. We reserve the right not to issue a refund, for example, we cannot issue refunds for text messages that aren't marked as "delivered" , marked as "sending" or marked as "sent".
  7. We reserve the right to issue refunds where you've selected the wrong API key and/or SMS country. Please ensure to follow all on-screen instructions and read all of the information presented to you carefully before purchase.
  8. We reserve the right to usse refunds due to using our API and providing inaccurate mobile numbers. Snapi SMS is designed to send to mobile numbers whom are aware of receive messages from us.
  9. If a customer has opted-out from Snapi SMS message communications, we reserve the right to issue refunds.
  10. Whilst we make every attempt to send messages to as many countries as possible, we reserve the right to issue refunds due to SMS messages not arriving in your recipients country. This is because we cannot guarantee the delivery of SMS messages as each network may choose to not issue delivery recipets.

12. Delivery Policy

  1. Upon receipt of your order, the services such as additional credits will be performed to you in accordance with the terms applicable to the services that you purchased. The nature of the services you purchased and the date of your purchase may impact the timing of the performance of the services, as such we will do everything we can do to ensure the smooth transition of your features. The services will be deemed to be successfully delivered to you upon the performance of the services.

13. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
